(1.) HAVING heard the learned Counsel for the Petitioner, the Court finds that the relief claimed by the Petitioner cannot be granted. The Petitioner has been awarded a degree in Bachelor of Hotel Management and Catering Technology from Kumaon University, Nainital and applied for admission in M.Com. or M.A. (Hindi). The Regulations framed by the Kumaon University provided the eligibility criteria for the admission in post -graduation courses. For the course of M. Com., the essential qualification is a Bachelor's degree in B. Com. or B.B.A. Admittedly, the Petitioner does not possess this qualification and consequently, his application form for the admission in M. Com. was not accepted by the University authorities. Similarly, for the admission in the course of M.A. (Hindi), the essential qualification is a Bachelor's degree in Arts, which, again, the Petitioner does not possess and consequently, was not eligible. The Petitioner, being aggrieved, has filed the present writ petition praying that the Regulations so framed are discriminatory and consequently, ultra vires the Constitution.
(2.) HAVING heard the learned Counsel for the Petitioner, the Court does not find that the Regulations so framed by the University are discriminatory in nature. A certain eligibility criteria has been fixed on certain norms, which, the Court does not find it to be erroneous. A person, who has a Commerce background having done B.B.A. or B.Com. and has graduated from that course, is eligible to apply for post -graduation course in M. Com. Similarly, a person graduating in Arts is eligible for post -graduation course in Arts which includes M.A. (Hindi).
(3.) IN the light of the aforesaid, the Court does not find any error in the action taken by the University. The writ petition is dismissed.
