JUDGEMENT

(1.) Heard Sri Mohinder Singh Bisht, the learned counsel for the petitioner, Sri Vinay Kumar, the learned standing counsel for respondent no. 1 and Sri B.D. Upadhyay, the learned counsel for respondent no. 2.

(2.) This petition has been filed under the garb of Public Interest Litigation by one Sri Ashok Tandon alleging himself to be the President of the Hydro Electric Employees Union (Intuc). In paragraph 1 of the writ petition, it has been alleged that Sri Ashok Tandon is the President of this Union and has been authorized to file the Public Interest Litigation and this organization is not only to look after the welfare of its members but also to check the corruption and malpractices in the Power Corporation Limited.

At the outset, neither the authorization letter has been filed nor the bye-laws of the Union has been filed to indicate that the organization is meant to check the corruption in the Power Corporation. It appears that the alleged President Sri Ashok Tandon has filed this petition in personal interest. Nothing has been indicated to show that the public at large is going to be benefited by the outcome of this litigation, and that if this petition is not filed, the public at large would suffer or that the employees of the Union is going to suffer. A perusal of Annexure-3 to the writ petition indicates that the President of the Union Sri Ashok Tandon had met the Chief Minister, who, in turn, had initiated an inquiry.
