JUDGEMENT

(1.) LEARNED counsel for the appellants affirms, that the controversy raised in the instant Special Appeal is identical to the one adjudicated upon by this Court in State of Uttarakhand and others versus Sanjay Kumar and others (Special Appeal No.112 of 2010, decided on 07.07.2010).

(2.) IN view of the above, the instant Special Appeal is dismissed in terms of the order passed by this Court in State of Uttarakhand and others versus Sanjay Kumar and others (Special Appeal No.112 of 2010, decided on 07.07.2010).
