(1.) Heard Mr. DCS Rawat, Advocate for the applicant and Mr. Amit Bhatt, Addl. GA for the State.

Learned counsel for the applicant submitted that he is the permanent Government servant holding the post of Pharmacist in the Health Department, Uttarakhand and was posted at Dehradun since 2006, and prior to his arrest he was posted at Primary Health Center Tuni, Distt. Dehradun and resided there with his family. He further the submitted that he is at all not connected with the same crime and whatever the allegations were made, those were against co-accused Sanjay Singh, Contractor and Ram Kishore, however no credible evidence could be collected against the applicant by the I.O. to connect him with the said crime. Lastly, he is in jail since last about one month.
(3.) After considering all the facts and circumstances and without expressing any opinion about the final merits of the case, the Court is of the view that the present applicant deserves bail at this stage.
