(1.) Petitioners are students who submitted applications for admission to Jawahar Navodaya Vidalayas to class VI for the academic year 2019- 2020. The writ petition was filed stating that the first respondent has approved an increase of 5000 additional seats for the academic year 2019-2020 and 10 seats would be therefore enhanced under the 4 th respondent. Petitioners also claimed that usually the percentage for urban seats was 25 or near to that. As per the guidelines, rural candidates are eligible for not less than 75% reservation. Pointing out that in the academic year 2017-18 and 2018-19, students from urban areas were granted admission against 23.75% and 22.5% seats, petitioners stated that in the year 2019-20 the admission was made only against 7.5% seats to candidates from urban areas. Petitioners have therefore prayed for a declaration that 25% of the seats in the 4th respondent School are to be allotted to candidates from urban areas for admission to class VI in the academic year 2019-20.
(2.) The learned Central Government Counsel filed a statement stating that there is not even a proposal for enhancement of seats in this academic year. It is also pointed out that as per the guidelines Ext.P1 at least 75% of the seats in a District would be filled up by candidates selected from rural areas.
(3.) Petitioners have already stated that they donot want to disturb the candidates who are already admitted.
