(1.) The second petitioner is the daughter of the first petitioner. The second petitioner applied for admission to five year B.Com. LLB course through the centralised allotment process of the State Government. The first option of the second petitioner was Ernakulam Government Law College. The second petitioner was not meritorious enough to obtain admission in the said college in the allotment process. She could however, secure admission for the course at the Calicut Government Law College. It is stated by the petitioners that later, when the competent authority initiated spot admission process for filling up the vacancies arose after the allotment process at the Ernakulam Government Law College, the second petitioner participated in that process. It is stated that though the second petitioner was found to be meritorious among the candidates applied for spot admission, she was denied admission as she did not make available the original of the Transfer Certificate. According to the petitioners, the conduct of the respondents concerned in insisting the original of the Transfer Certificate for spot admission was arbitrary, for, it was impossible then for the second petitioner to get the Transfer Certificate without losing the admission already obtained by her. The petitioners, therefore, seek appropriate directions in this regard, in the writ petition.

At the time of argument, the learned counsel for the petitioners submitted that though the time limit fixed for closing of the admission is over, since there are vacancies at the Ernakulam Government Law College for B.Com. LLB course and since less meritorious candidates have already been accommodated in the college for the course, the second petitioner is entitled to be accommodated in one of the said vacancies.
(3.) In the light of the said submission, the learned Government Pleader was asked to ascertain the correctness of the said fact, and the learned Government Pleader, after obtaining instructions from the competent authority, submitted that there is one vacancy.
