JUDGEMENT

(1.) This application is filed by the applicant under Section 438 of the Code of Criminal Procedure, 1973 seeking anticipatory bail in connection with the FIR, being Crime No.1308 of 2019, registered with the Ponkunnam Police Station, for offences punishable under Sections 406, 468 and 420 of the IPC.

(2.) The aforesaid crime was registered based on a complaint lodged by G.Sreenivasan, the proprietor of 'Anush Consultants'. The said concern is engaged in the business of overseas man power recruitment. In the complaint lodged by him, he alleges that the applicant introduced himself as a person working in the Ministry of Interior, Kuwait and persuaded him to believe that he is in a position to provide visa for the employment for nurses in the Kuwait Oil Corporation. Believing the words of the applicant, huge sums of money amounting to Rs.3 Crores were transferred to the accounts of accused Nos. 3 & 4, as suggested by the applicant. After receiving the money, the applicant and the 2nd accused are alleged to have forwarded forged Visas. This was confirmed by the officers of the Ministry of Interior, Kuwait. According to the de facto complainant, the accused, by practicing fraud, caused a wrongful loss of Rs.2.83 Crores.

(3.) The learned counsel appearing for the applicant submitted that there is absolutely no truth in the allegations levelled against the applicant. According to the learned counsel, he is working as a salesman in a fish market and he had no transactions with the de facto complainant.
