JUDGEMENT

(1.) This application is filed under Section 438 of the Cr.P.C.

(2.) The applicants herein are accused Nos. 1 to 4 and 6 in Crime No.483/2019 registered at the Munnar Police Station under Sections 143, 144, 147, 332, 323, 324 and 506 read with Section 149 of the Indian Penal Code.

(3.) The informant is the Preventive Officer, Excise Intelligent Investigation Bureau, Idukki. He along with his colleague Jolly Joseph was asked by Superior Officers to conduct patrol duty in the Chittuvara North Division. It is alleged that on 14.10.2019 at about 4.10 p.m., they came across a can containing 20 litres of illicit arrack. At the point of time, the 2nd accused one Rajan came to the spot. There occurred an altercation and a few minutes later, the rest of the accused reached the spot. It is alleged that the accused formed themselves into an unlawful assembly and in prosecution of their common object attacked the informant and his fellow officer with weapons and caused injuries.
