(1.) The petitioner in W.P.(C)No.26724 of 2019 is the president of the parent teacher association of Government U.P. School, Ayalur. In terms of Ext.P1 order therein, the Government permitted the Institute of Human Resources Development (IHRD) to start a technical higher secondary school in the vacant class rooms of the Government U.P.School, Ayalur. It is stated by the petitioner that later, a portion of the school compound was given by the Government to the IHRD and they have established a college therein, upgrading the original technical higher secondary school. It is also stated that despite having constructed sufficient building in the portion of the property allotted to the IHRD, they are yet to surrender the classrooms in the school. The case set out by the petitioner in the writ petition is that having found that the classrooms in the school are not anymore required for the college of the IHRD, the Government issued Ext.P4 order on 03.08.2019 directing the IHRD to return the classrooms occupied by them to the school. It is stated that IHRD is now attempting to pursue the Government to review Ext.P4 so as to enable them to occupy the portion of the school building also for their purpose. The petitioner, therefore, seeks a declaration that the classrooms, playgrounds and other facilities of the school are not liable to be given to the IHRD. Appropriate consequential directions are also sought in the writ petition.

W.P.(C)No.27820 of 2019 is a writ petition instituted by two of the students of the IHRD college challenging Ext.P4 in W.P.(C)No.26724 of 2019 and contending, among others, that there is dearth of space in the college and if the college is directed to return the school building presently occupied by the IHRD, the same will affect the classes. It is stated by the petitioners in the said writ petition that earlier IHRD was occupying two buildings of the school, of which, one has already been surrendered and since IHRD has erected an additional floor in the school building presently occupied by them, it was inappropriate for the Government to direct return of the said building to the school.
(3.) W.P.(C)No.28496 of 2019 is also a writ petition filed by a similarly placed student of the IHRD college challenging Ext.P4 order in W.P.(C)No.26724 of 2019.
