JUDGEMENT

(1.) This application is filed under Section 439 of the Code of Criminal Procedure.

(2.) The applicant herein is the 1st accused in Crime No.1152 of 2019 registered on 14.10.2019 under Sections 341, 323 and 324 of the IPC.

(3.) Aforesaid crime was registered at the instance of Shobha who alleged that on 12.10.2019 at about 9.30 pm, an altercation had occurred between her husband and the applicant herein at the Koorkancherry junction, consequent to which the applicant is alleged to have slapped her husband on his face. Her husband fell down on sustaining the blow and his head dashed on the hard tarmac and he became unconscious. He was rushed to the Medical College Hospital, Thrissur. While he was undergoing treatment as aforesaid, he succumbed to the injuries on 23.10.2019. Later, Section 304 of the IPC was incorporated.
