JUDGEMENT

(1.) This application is filed under Section 439 of the Cr.P.C.

(2.) The applicant herein is the 1st accused in Crime No.1148 of 2019 registered at the Kadavanthra Police Station. In the aforesaid Crime, he along with the 2nd accused are accused of having committed offence under Section 20(b)(ii)(B) of the Narcotic Drugs and Psychotropic Substances Act, 1985.

While investigating the Crime relating to theft of a motor bike, the accused in the aforesaid Crime were intercepted by the police on 19.8.2019 at 9.10 a.m., while they were standing near a bike in the Kaloor-Kadavanthra road. Both the accused were carrying shoulder bags. A search was conducted by the Detecting Officer and from them, several strips of Nitrozepam, a hypnotic drug of the benzodiazepine class, were seized. Specifically 180 tablets weighing 10 mgs. of Nitrozepam were found from the shoulder bag of the applicant and a strip containing 5 tablets were found in his trouser packet. Similar seizure was effected from the bag and body of the 2nd accused as well. The total quantity seized, according to the prosecution, is about 192 gms. They were arrested and they remain in custody.
