(1.) The petitioner is a member of the 4 th respondent Society. Election to the board of management of the Society is scheduled to be held on 03.01.2020. According to the petitioner, some of the voters whose names have been included in the voters list, a copy of which is produced as Ext.P3, are not persons who are entitled to be members of the society and therefore the inclusion of their name in the voters list is illegal. He therefore filed Ext.P4 complaint before the 3rd respondent, who is the Electoral Officer. When his complaint was not considered, he approached this Court and filed a Writ Petition. While the Writ Petition was pending, Ext.P5 order was passed rejecting his complaint. Reserving the right of the petitioner to challenge the order passed by the 3rd respondent, the Writ Petition was closed by Ext.P6 judgment. It is in the above backdrop that he has approached this Court seeking to quash Ext.P5 order issued by the 3rd respondent.
(2.) Heard the learned counsel appearing for the petitioner and the learned Government Pleader.
(3.) The learned counsel submits that the five persons whose names are made mention of in Ext.P4 are ineligible voters and they are not entitled to cast their votes.
