The petitioners claim to be the members of the fourth respondent-Co-operative Society and impugn Ext.P6 Final Voters List, published by the Electoral Officer appointed by the Co-operative Election Commission for the purpose of conducting elections to the new Managing Committee of the said Society, making the specific allegation that the statutorily imperative details required in a Final Voters' List are missing in Ext.P6.

The petitioners have also raised corollary objections to the manner in which the statutory identity cards are being distributed by the Society, alleging that out of the total membership strength of 55,000, only 5,000 or so members have been issued such identity cards yet. The petitioners, therefore, pray that the election processes being taken forward by the Election commission, through Exts.P1 and P2 notifications, be set aside.

In response to the afore submissions of Sri.M.Sasindran - learned Counsel for the petitioners, learned Senior Counsel Sri.George Poonthottam, assisted by Smt.Nisha George - learned counsel appearing for the petitioners, submitted that Ext.P6 list is not vitiated, as has been alleged by the petitioners, but concedes that there were certain omissions therein on account of an error caused by the computer system. He says that this was also became the addresses of the members may not be available at times because their temporary addresses keep changing-they being all police men; and therefore, that the addresses of few members were missing in the Final Voter's List. He says that when this writ petition was filed, the Chief Executive Officer of the Society, on being alerted of this, furnished all these details to the Electoral Officer but that the said Officer is yet to take a decision thereon. He, therefore, prays that the elections be allowed to be conducted without any interdiction from this Court and that the Electoral Officer be directed to take an appropriate decision on the additional information given by them with respect to the voters' list, within a period of two days, so that the date of polling need not be adjourned.
