JUDGEMENT

(1.) The petitioner is aggrieved by the refusal on the part of the respondents in making necessary corrections with regard to his date of birth as entered in the school and CBSE records so as to be in tune with the entry of date of birth as certified in Ext.P-2 statutory birth certificate issued under the enabling provisions contained in the Registration of Births and Deaths Act, 1969. The prayers in the above Writ Petition (Civil) are as follows: "i. to issue a writ of mandamus or any other appropriate writ, order or direction directing the respondent No.1 to consider the Application (Exhibit P-4) of the petitioner pending before the respondent No.1 and to Correct the Date of Birth of the petitioner in the Certificate of Mark Statement of Secondary School Examination (Exhibit P-1) from 30/09/1993 to 30/09/1992. ii. To issue a writ of mandamus or any other appropriate writ, order or direction directing the respondent No.1 to correct the Date of Birth of the petitioner in the Certificate of Mark Statement of Secondary School Examination as per the Certificate of Birth (Exhibit P-2) and the Passport of the petitioner (Exhibit P-3). iii. to grant such other reliefs which deems fit and proper in the circumstances of the case."

(2.) Heard Sri.P.K.Manomohanan, learned counsel appearing for the petitioner and Sri.S.Niramal, learned Standing Counsel for the CBSE appearing for R-1 and R-2. In the nature of the order that is proposed to be passed in this petition, notice to R-3 will stand dispensed with.

According to the petitioner, his date of birth has been correctly shown and certified in Ext.P-2 statutory birth certificate as "30.9.1992" and the said birth has been so registered thereby on 1.10.1992. That mistakes had occurred while entering his date of birth in the school records at the time of his admission in the school, whereby it was erroneously shown as "30.9.1993" and correspondingly, the said mistakes had also been repeated in the respondents CBSE records like Ext.P-1 mark list dated 26.5.2009, etc. That the petitioner's date of birth has been correctly shown in Ext.P-3 passport issued by the Government of India, which is in tune with Ext.P-2 statutory birth certificate. The petitioner was advised that if the said mistakes in the school and CBSE records are not corrected, it might create unnecessary hurdles and difficulties for him while pursuing academic studies and employment opportunities abroad, etc. Therefore, the petitioner had submitted Ext.P-4 application dated 21.11.2018 before the 1st respondent CBSE praying for correction of the date of birth in the CBSE records like Ext.P-1 so as to be in tune with the entry of date of birth as shown in Ext.P-2 statutory birth certificate, etc.
