NIRMALA EDUCATIONAL TRUST Vs. STATE OF KERALA

JUDGEMENT

(1.) The petitioner Trust is running a Self Financing Institution with the name Nirmala College of Arts and Science, Chalakudy. Pursuant to Ext.P4 notification issued by the University inviting application for affiliation for starting new Colleges/Programmes and permanent increase of seats for the year 2019-20 and 2020-21, the petitioner College submitted Ext.P5 application to start new P.G.Course namely M.Com Finance.

It is stated that the University conducted an inspection and thereafter a re-inspection as seen from Ext.P6 letter dated 29.05.2019 for which petitioner had remitted the requisite fee as per Ext.P7 letter and challan. The University thereafter as per Ext.P8 letter dated 06.07.2019 addressed the Principal Secretary to Government, Higher Education Department, stating as follows:

(3.) The petitioner College is Serial No.37 in the list. The programme and intake requested is M.Com (Finance) with 15 seats. The writ petition was filed stating that even after the University had addressed the Government requesting for its views as per Ext.P8 order on 06.07.2019, the Government has not taken any action and any delay will affect the petitioner seriously as the admissions would be closed by 31.08.2019.
