JUDGEMENT

(1.) Ext.P3 order passed by the District Collector, Palakkad, on 9.11.2009 directing the petitioner to furnish bank guarantee for obtaining interim custody of his vehicle is under challenge in this writ petition. The petitioner contends that river sand carried in his vehicle was sand purchased from the State of Tamil Nadu and therefore the District Collector erred in imposing onerous conditions for granting for obtaining interim custody of the vehicle.

(2.) Ext.P3 discloses that the District Collector will hear the petitioner for the purpose of passing final orders on 23.12.2009, that is within another two weeks from today. If the petitioner is not willing to comply with the conditions stipulated in Ext.P3, he can await the final order, which will be passed shortly instead of obtaining interim custody of the vehicle. I therefore find no grounds to entertain this writ petition. The writ petition fails and is dismissed leaving open the petitioner's contentions and reserving liberty with him to raise all his contentions before the District Collector at the time of hearing on 23.12.2009.
