(1.) Heard the learned counsel appearing for the petitioners and Sri.P.C.Sasidharan, the learned standing counsel appearing for the University of Calicut.
(2.) The petitioners appeared for the First Professional MBBS Degree Examination conducted by the University of Calicut in August, 2009. The first petitioner in W.P.(C) No.33190 of 2009 failed in two papers namely, 'Anatomy' and 'Bio- chemistry' and the second and third petitioners failed in 'Anatomy', 'Bio-chemistry' and 'Physiology'. The petitioners in W.P.(C) No.33197 of 2009 failed in 'Anatomy' and 'Physiology including Bio-physics'. The petitioner in W.P.(C) No.33227 of 2009 has failed in one paper 'Anatomy' and the petitioners in W.P.(C) No.33257 and 33277 of 2009 failed in the paper 'Physiology'. The petitioners in W.P.(C) No.33239 of 2009 failed in two papers namely, 'Anatomy' and 'Physiology'. The petitioners in W.P.(C) No.33246 of 2009 failed in 'Anatomy', 'Physiology' and 'Bio-chemistry'. The petitioner in W.P. ) No.33276 of 2009 failed in two papers namely 'Physiology' and 'Bio-chemistry'. They have therefore applied for revaluation of their answer scripts. It is submitted that the requisite fee has also been paid. The petitioners submit that they had done well in the examination and that they are hopeful of securing a pass if their answer scripts are revalued. They also submit that without passing the first year examination, they cannot attend classes during the second year of the MBBS course which will commence on 11.11.2009 thereby visiting them with adverse consequences. On these grounds, the petitioners seek expeditious revaluation of their answer scripts.
(3.) Sri.P.C.Sasidharan, the learned standing counsel for the University of Calicut submits that the pass percentage for the First Professional MBBS Degree Examination is below 61% in all the Medical Colleges affiliated to the University of Calicut taken together, that a large number of candidates are likely to seek revaluation and therefore it would not be possible to revalue the petitioners' answer scripts and communicate the result to them within two weeks as prayed for in these writ petitions. He submits that the last date for submission of applications for revaluation is 18.11.2009 and that within eight weeks thereafter, the University will revalue the petitioners' answer scripts and communicate the result to them. In the light of the said submission, I dispose of these writ petitions with a direction to the respondents to take steps to have the petitioners' answer scripts revalued and to communicate the result to them expeditiously and in any event, within eight weeks from the date on which the petitioner produce a certified copy of this judgment before the Controller of Examinations, University of Calicut.
