(1.) In this writ petition, the petitioner challenges Ext.P2 order passed by the Revenue Divisional Officer, Thiruvananthapuram on 25.8.2008 declining to register her birth. The petitioner also seeks a direction to the third respondent to register her birth.
(2.) The date of birth of the petitioner is given in the Secondary School Leaving Certificate as 1.6.1954. The petitioner contends that she was born on 1.6.1956 and that at the time when she was admitted in the school, her date of birth was wrongly given. Relying on the provisions contained in the Registration of Births and Deaths Act, 1969, the learned counsel appearing for the petitioner contends that the petitioner is entitled to have her birth registered after obtaining an order from the Revenue Divisional Officer.

The Revenue Divisional Officer rejected the petitioner's request for permission to register her birth, showing the date of birth as 1.6.1956 on the ground that it is with a view to enable the petitioner to seek correction of her date of birth in the service records and that such correction is not permissible at this distance of time in view of G.O. (P) No.45/91/P & ARD dated 30.12.1991 which stipulates the conditions subject to which Government employees like the petitioner can seek correction of their date of birth in the service records. The Government have in the said order stipulated that Government servants should move for correction of their date of birth in the service records after getting the school records corrected within a period of five years from the date of entry in service. As regards persons who were in service as on 30.12.1991, the stipulation is that such applications should be made within one year from the date of the Government order. In such circumstances, the petitioner cannot at this distance of time seek correction of her date of birth in the service records. If that be so, I find no reason why at this belated stage the petitioner should have her birth registered. The exercise undertaken by the petitioner is of purely academic interest and will not confer on her any right to seek correction of her date of birth in the service records. I therefore decline jurisdiction and dismiss the writ petition.
