JUDGEMENT

(1.) This application is filed under 439 of the Cr.P.C .

(2.) The applicant herein is the accused in Crime No.680 of 2018 registered at the Chathannoor Police Station under 323, 294(b), 363, 366 and 376 of the IPC and 3, 4 and 5 r/w. 6 of the Protection of Children from Sexual Offences Act, 2012.

(3.) The prosecution allegation is that the applicant enticed the minor girl by feigning love and with the permission of her mother, married the victim. They resided together for a couple of years and a child was also born in the wedlock, on 09.07.2016. The relationship between the parties became strained and he started harassing the girl both mentally and physically. Tormented by acts of the applicant, the victim approached the police, on 15.9.2018, and gave a statement, based on which, the subject crime was registered.
