Three petitioners are before us in these writ petitions alleging that respondents 9 to 13 have been granted admission to the MBBS course in the college of the 5 th respondent on the basis of community certificates that are fake. The petitioners are qualified candidates in the NEET 2018. They claim to be persons who are entitled to be considered for admission to the 5th respondent college in the minority quota. They have not been able to get admission for the reason that other ineligible persons, respondents 9 to 13, have been granted admission. They had complained to the authorities including the Chief Minister. Since no action was taken in the matter, they have approached this Court. They have therefore sought the following reliefs:
(2.) According to the averments in the writ petition, the disputed certificates, evidenced herein by Exts.P22 and P23 are all issued by one Rt:Rev.David V. Lukose. It is alleged that the same is a fictitious name. However, he has been arrayed as 7th respondent herein. He has been served with notice and has entered appearance through counsel. He has also filed a counter affidavit. Therefore, the allegation that he is fictitious, appears to be without any basis.
(3.) The second limb of the complaint of the petitioner is that Ext.P21 certificate is issued to a person who is a permanent resident of Coimbatore, Tamil Nadu. Though she is stated to be a member of St. Andrews CMS Anglican Church, Nedumkunnam, Kottayam, it is alleged that there is no such church by that name. With respect to Ext.P22 certificate produced by the 11th respondent, the allegation is that the St.Peters CMS Anglican Church, Pathanamthitta, which is described as her parish is not in existence. With respect to which Ext.P23 certificate produced by the 12 th respondent, the Parish mentioned is St.Andrew's CMS Anglican Cathedral Church, Velluthuruthy, Kuzhimattom P.O. According to the petitioners, there is no such church in the said name.
