(1.) This application is filed under section 438 of the Code of Criminal Procedure, 1973.
(2.) The applicant has been arrayed as the accused in Crime No.550 of 2018 of the Mannanthala Police Station registered under Sections 294B, 506(i), 354C and 420 of the Indian Penal Code.
(3.) The victim in the instant case is a lady aged 28 years and is working as an Assistant Manager, Kerala Gramin Bank at Thiruvananthapuram. The applicant on the other hand is the Assistant Manager of the same Bank and stationed at Attingal. They joined service on the same day and their casual acquaintance bloomed into a love affair. The applicant is alleged to have expressed his desire to marry her. They used to travel together and used to communicate online as well. While so, sometime in the month of November, 2017, the applicant persuaded the victim to send her nude photographs online. Under the firm belief that the applicant would marry her, the victim obliged. However, thereafter, their relationship strained and the applicant informed the victim in no uncertain terms that he was not inclined to marry her. It is alleged that after withdrawing from marriage, the applicant threatened the victim that he would propagate her photographs online. Based on these allegations, the aforesaid crime was registered.
