(1.) This application is filed under section 438 of the Code of Criminal Procedure, 1973.
(2.) The applicants herein are the Chairman, Vice Chairman and General Secretary respectively of the Indian Red Cross Society, Kerala State Branch. They have been arrayed as accused Nos.1 to 3 in CBCID Crime No.182/CR/EOW- 1/KLM/16.
(3.) One Sri. Bhaskaran, who was one of the members of Managing Committee of the Red Cross Society, Kerala Branch, filed a complainant before the authorities concerned, including the Governor of Kerala, raising grave allegations against the activities of the applicants as the principal office bearers of the Society and the mode in which it was managed by the applicants. The said representation was forwarded with a direction to conduct a comprehensive enquiry into the affairs of the Indian Red Cross Society, Kerala State Branch. An enquiry was conducted and it was revealed that there was abuse of power, nepotism, corruption, mismanagement and siphoning off of public money. Consequently, a crime was registered at the CBCID Headquarters and the investigation was taken over by the CBCID.
