VAYALILLAKATH FEROSEKHAN Vs. SUB INSPECTOR OF POLICE

JUDGEMENT

(1.) This application is filed under S.439 of the Crimial P.C.

(2.) The applicant herein is the 22nd accused in Crime No.240 of 2012 of the Areacode Police Station. Proceedings against him are now pending as C.P. No.32 of 2018 on the file of the Judicial Magistrate of First Class-I, Manjeri.

(3.) The case has a chequered history. A certain Sri.Abdul Kalam Azad and his brother Kolakkadan Aboobacker were murdered by a group of persons on 10.6.2012. On 11.6.2012, on the basis of information given by one Kolakkadan Najeeb, an FIR was registered inter alia under Sec. 302 of the IPC. After completion of investigation, split charge was laid before the learned Magistrate. The case was committed to the Court of Session and is pending as S.C.No.99 of 2013.
