JUDGEMENT

(1.) This petition is filed under Section 438 of Cr.P.C. for pre-arrest bail .

(2.) The petitioner is the sole accused in Crime No.428 of 2018 of Valapattanam Police Station registered for the offence punishable under Section 420 IPC.

(3.) The prosecution allegation is that the petitioner as the Secretary of Valapattanam Labour Contract & Welfare Co-op.Society registered under the Co-operative Societies Act with the main activity of extracting river sand using man power of the members of the Society and selling the same, in the year 2013, collected an amount of Rs.19,500/- each from the de facto complainant and others offering share of profit of the Society. But later he refused to give the share of profit to its members and thus cheated the persons who offered money and thereby committed the aforesaid offences.
