JUDGEMENT

(1.) The petitioner seeks regular bail by this petition filed under section 439 of the Code of criminal Procedure, 1973. His earlier application was dismissed by order dated 1.12.2017.

(2.) For having murdered his father and mother, the petitioner herein is charged under Sections 302 and 201 of the Indian Penal Code. The final report has been laid and the case is now pending before the Court of Sessions, Pathanamthitta as S.C. No. 460 of 2017.

(3.) According to the prosecution, the petitioner along with his wife and child were residing with his aged parents. The petitioner had a grievance that his daughter was not being properly looked after by his parents. On 25.06.2017, there occurred an altercation between the petitioner and his father. His father also used to reprimand him for not taking up any employment. It is alleged that on 25.6.2017, at about 3 p.m., the petitioner with intent to cause murder of his father clouted him and when he had fallen down, inflicted repeated blows on his head with a wooden stick causing his death. At about 5 p.m., his mother returned home and it is alleged that the petitioner dealt a blow on the back side of her head causing fatal injuries. On 26.6.2017, he managed to wrap the dead bodies in a tarpaulin and took it to an unused well in the property of late Leelama John in a car and dumped the bodies in the well. It is further alleged that on 1.7.2017, he arranged an earth mover to be brought to the place and filled up the well with earth with intent to wipe off the evidence.
