JUDGEMENT

(1.) This application is filed under Section 438 of the Code of Criminal Procedure.

(2.) The applicant herein is the 2nd accused in Crime No.1236 of 2018 registered at the Njarakkal Police Station under Sections 332, 143, 145, 147, 224, 225 and 341 r/w Section 149 of the IPC.

(3.) The 1st accused in the aforesaid Crime, one Anti @ Antony, is the accused in Crime No.7 of 2018 of the Njarakkal Police Station. On 25.5.2018, the Assistant Excise Inspector of Njarakkal Excise Range, along with his party, arrested the aforesaid Antony. It is alleged that Antony alerted his friends and relatives who came to the spot and used force to rescue Antony from the custody of the Excise officers. While rescuing Antony as aforesaid, they are alleged to have assaulted the Excise officers causing injuries.
