JUDGEMENT

(1.) This is an application filed under Sec.438 of the Cr.P.C.

(2.) The petitioner is the 1st accused in Crime No.573 of 2018 of Kollam East Police Station. The said crime was registered against the petitioner and two other identifiable persons for the offences punishable under Sections 294(b), 323, 324 and 308 r/w Sec.34 of IPC.

(3.) The prosecution case is that on 22.03.2018, at 11.55 p.m., the petitioner along with two other identifiable persons, due to the previous enmity towards the de facto complainant and his friends who are participating the University Kalotsavam held at S.N College, Kollam, assembled adjacent to the main stage and questioned them by using abusive words and slapped one person named Shanu. When the de- facto complainant interfered, the 1st accused/petitioner attacked him with a stone and sustained injuries on the lower side of the left eye.
