JUDGEMENT

(1.) This is an application for anticipatory bail filed under Section 438 Cr.P.C., 1973

(2.) The first and the second petitioners are the first and the third accused in the case registered as Crime No.427/2018 of the Poovar Police Station under Sections 323, 324, 326 and 307 read with 34 IPC (The name of the first petitioner is shown as Biju Abraham in the petition. But, as per the report of the Investigating Officer, the name of the first accused in the case is Biju Kumar). The report of the Investigating Officer shows that the third and the fourth petitioners are not accused in the case. (The name of the second accused is Vincent but the name of the fourth petitioner is Wilson).

(3.) The prosecution case is that, on 31.03.2018, at about 09.30 hours at Arumanoorkkada Junction, accused 1 to 3 in the case together attacked one Justin Raj with deadly weapons and made an attempt to kill him. It is alleged that the first and the second accused beat the victim with iron rods and when he fell down, the third accused kicked him on the chest with his legs. It is further alleged that the first and the second accused beat the victim on both legs several times with iron rods and caused fracture to the bone of his legs. The victim sustained fracture to the skull in the attack made by the accused.
