THOMAS MATHAI Vs. STATE OF KERALA AND OTHERS

Decided On February 05, 2018
THOMAS MATHAI Appellant
V/S
STATE OF KERALA AND OTHERS Respondents

JUDGEMENT

(1.) Appellant Thomas Mathai, a senior citizen, owns a piece of property-rubber plantation. At one time, the land was subjected to land ceiling proceedings under the Kerala Land Reforms Act. Eventually, whatever land remained with Thomas Mathai after those proceedings, he proposed to have it conveyed to a company formed by himself.

(2.) With the above objective, when Mathai presented a deed of conveyance to the third-respondent Sub Registrar, he refused to register it. He refused because on 31.05.2016 the Chairman of the Taluk Land Board issued a directive that lands covered by survey numbers mentioned in that communication should not be registered. So the Sub Registrar passed Ext.P4 order of refusal, assailing which Thomas Mathai filed W.P(C). No.36187 of 2016.

(3.) The learned Single Judge, through a judgment dated 25.11.2016, held that the appellant has an efficacious alternative remedy under Section 72 of the Registration Act. Aggrieved, Mathai is before us.
