The petitioner, a student admitted to the MBA course during the academic year 2018-2019 to the fourth respondent College is before us challenging the action of the third respondent in declining to grant approval to his admission. According to the petitioner, he has passed the B.Com. Degree of the second respondent University in the year 2017. He has secured 1678 marks out of 3500 marks with a Cumulative Credit Point Average (CCPA) of 5.50 and D grade. His consolidated mark-cum-grade card is evidenced by Ext.P1. According to him, 'D Grade' is given to a student whose CCPA is above 5, but less than 6. As per the Kerala Technological University Regulations, students who have qualified for the Bachelors Degree with 50% marks in aggregate or equivalent CGPA for Part III or core subjects are eligible to apply for admission to MBA Course. Since the petitioner satisfied the said criterion, he was eligible to apply for the course. Accordingly, he was selected and admitted by the fourth respondent to the said course. However, while considering the question of granting approval to the admissions made by the fourth respondent, the third respondent has held that, the petitioner was not entitled to be granted admission.
(2.) The third respondent required the College to explain the circumstances under which the petitioner was granted admission. Accordingly, the Principal had, by submitting Ext.P4, explained matters to the third respondent. However, without considering the explanation, grant of approval to the admission of the petitioner has been rejected by Ext.P5. It is contended that, the eligibility criterion is either 50% marks in the core subjects or equivalent CGPA. According to the petitioner, his CCPA is equivalent to 50% marks and therefore, he was entitled to be granted admission. For the above reason, it is contended that, his admission is only to be approved.
(3.) According to Adv. Mary Benjamin who appears for the third respondent, going by Ext.P1 marklist, the petitioner has not obtained 50% marks for Part III or core subjects. On the basis of the marks obtained by him, his grade point has been calculated to be 5.60 in Ext.P1. CCPA of 5.60 counts only for a percentage of less than 50%. The CCPA of a student who secured 50% marks had to be 6, it is pointed out.
