JUDGEMENT

(1.) This application is filed under Section 439 of the Cr.P.C.

(2.) The applicant herein is the 3 rd accused in Crime No.126 of 2018, registered at the Kondotty Police Station, under Sections 4 and 5 of the Explosive Substances Act, 1908 and under Section 286 of the IPC.

(3.) According to the prosecution, information was received by the Station House Officer, Kondotty Police Station, that a lorry bearing Reg. No.KA-46-5639 was parked in front of M/s. World Wood Timber, Mongam, in suspicious circumstances. The officer reached the spot and a search was conducted. 272 boxes of gelatine sticks, large number of detonators and fuse wires were found concealed inside the lorry. The driver and cleaner were arrested and the explosives were seized. When the accused Nos.1 and 2 were questioned, they are alleged to have disclosed about the role of the applicant. Based on the information furnished, a search was conducted in a nearby godown allegedly possessed by the applicant. Explosives were found stored in the godown as well. The godown belonged to the mother and sisters of the applicant and he was in possession of the same.
