Interference declined by the learned single Judge with regard to the challenge raised by the petitioner/appellant against his transfer from the post of Enforcement Officer at the Head Office of the Kerala Agro Industries Corporation Limited at Thiruvananthapuram, as General Manager (in charge), Kerala Agro Fruits Products Punalur, as per Ext. P9 proceedings, is sought to be subjected to scrutiny by this Court in this appeal.
(2.) Heard Sri. Ramesh Chander, the learned senior counsel appearing for the appellant as well as Sri. E. K. Nandakumar, the learned senior counsel, who entered appearance on behalf of the respondent Company, besides the learned Government Pleader appearing for the State/Department authorities.

The sum and substance of the case projected before this Court is that the respondent Company is a fully owned Government of Kerala undertaking and that the petitioner joined said Company as an Enforcement Officer on 25.01.1995, based on the selection proceedings pursuant to Ext. P1 notification issued in this regard. The selection and appointment was based on the qualification and credentials possessed by the writ petitioner/appellant, particularly he being a law graduate and also taking note of the nature of duties to be performed as Enforcement Officer. The fact remains that he tendered resignation in the year 1999 so as to join the Central Bank and accordingly left Company. However, pursuant to a subsequent notification issued by the Company, he opted to come back and it was readily accepted by the Company and gave him appointment as Enforcement Officer vide Ext. P2 dated 21.06.2000, who was continuing as above.
