JUDGEMENT

(1.) This application is filed under Section 439 of the Code of Criminal Procedure.

(2.) The applicant herein is the accused in Crime No.439 of 2018 of the Oonnukal Police Station. He is accused of having committed offences punishable under Sections 450 and 376(2)(1) of the IPC.

(3.) The applicant herein is a relative of the survivor, who is a lady aged 30 years, with mental derangement. According to the prosecution, on 19.05.2018 at 4.45 p.m., the applicant with intent to commit sexual assault on the victim, trespassed into her house and pushed her down. He is alleged to have made an attempt to remove her dress. On hearing the hue and cry of the lady, the de facto complainant, who is her niece, came to her rescue. The applicant is alleged to have left the scene immediately thereafter.
