(1.) Petitioner's daughter Manjusha was married to one Babu on 15.07.2005. A child was born in the matrimonial relationship. Babu was employed abroad. Thereafter, he came to India on 07.07.2011 for a visit. On 09.07.2011 night, Manjusha was found dead at the matrimonial house. She was immediately taken to the hospital and post-mortem conducted. It revealed that the death was due to hanging. Crime was registered accordingly under section 306(1)(C) for unnatural death.
(2.) According to the petitioner herein, he was informed about the death of the daughter only on 10.07.2011. It was alleged by him that, he visited the hospital and found that body carried several injuries. However, in the post-mortem report, these injuries are not seen referred to. It was alleged that the husband Babu and the in-laws had subjected her to extreme cruelty and thereby caused her death. On 10.07.2011 itself, a complaint was laid before the Sub Inspector of Police by the son of the petitioner herein. Later, by Ext,P2, a report was filed converting the offence to section 498A and 34 of the Indian Penal Code. The husband and some of the inlaws were arrayed as the accused. Thereafter, brother of the husband, his wife and sister of the husband were arrested. Husband in the meanwhile, had left India and obtained anticipatory bail. According to the petitioner herein, police did not investigate the case properly and under the influence of the accused, crucial offences were not attributed to the accused. It was stated that, originally, crime was registered under section 306 IPC. Hence, Ext.P3 complaint was laid. Thereafter, original petition was filed seeking a relief for a direction for further investigation to be entrusted to the CBI or any other officer of the Crime Branch.
