(1.) These writ petitions concern Imam Hussain Memorial Basic Training School, hereinafter referred to as the " Training School"). The Manager of the Training School, on behalf of the Educational Agency, which run the Training School has approached this Court with W.P.(C).Nos.16396/2018 and 30164/2018 aggrieved by various orders including withdrawal of permission granted by the Government. W.P.(C).No.30517/2018 is filed by the teaching and non-teaching staff of the Training School. The Training School was established in the year 1963. It is an aided school. The Educational Department of the Government granted permission to Milad-e-Sheriff Committee, Chinnakkada, Kollam, to establish the school for teachers' training at Kollam.
(2.) Karbala Maidan in Kollam was under the possession of Muslim Community for a long period. It appears to have been given by the British for using for religious purposes. At the inception of the Training School, it had started functioning in Karbala Maidan. The Karbala Maidan is having more than 11 Acres of land.
(3.) The Parliament enacted National Council for Teacher Education (NCTE) in the year 1993. It is not disputed, after the enactment as above, NCTE permission is required to offer programme in teachers' training. The Training School appears to have obtained permission from NCTE. The Southern Regional Committee noted that the Training School does not have the required facilities to offer quality teachers' training programme. Accordingly, they issued a notice to the Training School in the year 1999. From the year 2000 onwards no permission was granted to the Training School.
