JUDGEMENT

(1.) This is an application seeking pre-arrest bail.

(2.) Crime No. 9 of 2018 of the Chathanur Police Station was registered by the Sub Inspector of Police, Chathannur on 3.1.2018 under section 302 r/w section 34 of the IPC against one Aneesh and 2 others for having murdered one Akash. A near relative of the deceased was the first informant.

According to the informant, deceased Akash, who was about 20 years of age, came to the house of his friend Dileep which was situated near to the Gas Agency at Pallimon in an inebriated stage on 2.1.2018. There occurred an altercation between Akash and Dileep. The deceased hurled abuses at his friend which irked the accused Nos. 1 to 3, who are allegedly employees of the adjacent Gas agency. They came out and warned the deceased. Enraged, the deceased is alleged to have entered the premises of the Gas agency and pushed down a bike. The 1st accused is alleged to have confronted the deceased and he was told that he would be taught a lesson. After some time, Akash returned with an iron rod and destroyed the glass window panes of the Gas agency and also demolished the wind shield of a Pick-up van which was parked there. The deceased then left the place. While the deceased was walking back through the public road, the accused Nos. 1 to 3 boarded the pickup van and followed the deceased. They then accelerated the vehicle and rammed it on the body of the deceased. Akash sustained very grievous injuries and he was immediately removed to the Azzeezia Medical College Hospital from where he was referred to the Medical College Hospital Thiruvananthapuram. He was declared dead on 3.1.2017. Immediately thereafter the incident was reported and the crime was registered.
