JUDGEMENT

(1.) This application is filed under Section 438 of the Code of Criminal Procedure.

(2.) The applicant herein is the accused in Crime No.1048 of 2018 registered at the Ernakulam Town South Police Station, under Sections 406 , 417 and 420 of the Indian Penal Code.

(3.) The applicant is the Managing Director of M/s. Green Channel Holidays (Pvt.) Ltd. He arranged group travel for de facto complainant and others to Dubai. The travel was in a crew ship and the period was from 15.4.2018 till 22.4.2018. The facilities offered by him below par according to the complainant, and he did not travel with the group as earlier assured. The tour party comprised of aged men and women and they had to fend for themselves as an inexperienced person was entrusted with all responsibility.
