JUDGEMENT

(1.) This application is filed under section 439 of the Code of Criminal Procedure, 1973.

(2.) The applicant herein is the 2nd accused in Crime No.270 of 2018 of the Kottiyam Police Station, registered under Sections 457, 461, 380, 201 and 457 r/w Section 34 of the IPC.

(3.) The prosecution allegation is that in the late hours of 17.3.2018, the applicant herein along with rest of the accused, committed theft of a sum of Rs. 6 lakhs from an ATM of 'India One' Bank installed near the Ganapathy temple at Thazhuthala.
