JUDGEMENT

(1.) The petitioner says that he is running a washing powder manufacturing Unit and he alleges that respondents 6 and 7 are obstructing the same. The pleadings on record would show that the respondents 6 and 7 are alleged to be obstructing the activities of the petitions based on an apprehension that the said activity will cause pollution in the area and also on the further allegation that the petitioner is operating the Unit without necessary licences under the Drugs and Cosmetics Act, 1940 and its Rules.

(2.) We notice that this Court had taken note of all the allegations and counter allegations as disclosed by the pleadings on record and had directed the Pollution Control Board to make an inspection of the premises and report to this Court if there was any pollution. The Pollution Control Board has now filed a report, wherein they say that only some smell was detected in the premises but that there is no other pollution.

(3.) The learned counsel for the petitioner submits that in view of the report of the Pollution Control Board, the interim order earlier granted to him to operate the unit may be confirmed. He says that the writ petition may thus be ordered.
