SAJITH AND OTHERS Vs. STATE OF KERALA

JUDGEMENT

(1.) This application is filed under ?439 of the Code of Criminal Procedure.

(2.) The applicants herein are the accused Nos.8 and 9 in Crime No.527 of 2018 of the Ottappalam Police Station, registered under ??143, 147, 148, 341,323, 324 and 302 read with ?34 of the IPC.

(3.) The prosecution allegation is that on 9.6.2017 at 7.30 p.m., a group of persons numbering 10 , formed an unlawful assembly with the requisite knowledge , and in prosecution of their common object, wrongfully restrained Prajin, the deceased in the instant Crime, and attacked him with deadly weapons. Prajin was later found near the scene of Crime with serious injuries. He was immediately removed to the P.K.Das Hospital, where he was pronounced dead.
