JOMON PUTHENPURACKAL Vs. DIRECTOR, CBI

JUDGEMENT

(1.) In this petition filed by the petitioner (Jomon Puthenpurackal) claiming himself to be a human rights activist, he seeks specific directions to the CBI, to conduct further investigation within a time frame to be fixed by this Court and to submit a final report regarding the homicide of a nun by name Sister Abhaya that occurred within the premises of St. Pius Xth convent, Kottayam. The petitioner wants this Court to call for the progress report filed by the CBI, before the Chief Judicial Magistrate, Ernakulam and also to call for the narco analysis report submitted before the Chief Judicial Magistrate.

(2.) The above writ petition filed by the petitioner was disposed of on 11/01/2008 directing the CBI to produce the reports of the narco analysis conducted on the 3 suspects in sealed covers both before the Chief Judicial Magistrate's Court, Ernakulam and before this Court.

(3.) This petition was vehemently opposed both by the Standing Counsel for the CBI as well as the learned counsel appearing for the father of deceased Sr. Abhaya.
