JUDGEMENT

(1.) The prayer in this Crl.M.C is to set aide the impugned order dated 16.2.2017 rendered by the Judicial First Class Magistrate Court, Piravom, in Crl.M.P.No.248/2017 filed by the petitioner-complainant in C.C.No.87/2016 and to direct the said Magistrate Court to issue summons to PW-2 (Bank Manager, Gramin Bank, Piravom Branch) who is cited as prosecution witness No.2 by the complainant in C.C.No.87/2016 to adduce evidence on behalf of the complainant, etc. This Court while admitting the petition has passed interim order dated 27.3.2017 in this petition which reads as follows:

(2.) Now, notice has been duly served on R-1. But there is no appearance for that party.

(3.) Heard Sri.Georgie Simon, learned counsel appearing for the petitioner and Sri.Saigi Jacob Palatty, learned Prosecutor appearing for R-2 State.
