JUDGEMENT

(1.) The petitioner herein is the sole accused in Crime No.1131 of 2017 of the Vadakkanchery Police Station registered under Sections 447, 341, 323, 324 and 308 of the Indian Penal Code. He seeks regular bail under Section 439 of the Code of Criminal Procedure. The application filed by him for regular bail was dismissed by the learned Judicial First Class Magistrate-I, Alathur on 19.09.2017. The petitioner has been in judicial custody since 15.09.2017.

The prosecution case is that at about 5.30 p.m on 11.09.2017, the petitioner trespassed into the house of the de facto complainant, assaulted him, and inflicted serious injuries on his body with weapons with the knowledge of consequence that the injuries may cause death. On a perusal of the wound certificate in the name of the complainant, I find that he had sustained some injuries including a lacerated 4.cmx2c.mx1c.m near the vertex over the right parietal region, and another lacerated wound over the maxillary region, besides other simple injuries. (3.) This application for regular bail is opposed by the learned Public Prosecutor on the ground that investigation is still in progress, and that if the accused is now released, he will definitely obstruct the investigation.
