JUDGEMENT

(1.) Petitioners who are Selection Grade Assistants working in the Kerala University, are aggrieved by the delay in granting them promotion as Section Officers.

(2.) The petitioners joined the University as Assistant Grade II in the year 2008. Their selection and appointment was under challenge before the Upa Lok Ayukta and this Court. They were granted promotion as Senior Grade Assistants and Selection Grade Assistants in February 2017, consequent to directions in the judgment in Writ Petition No.491 of 2012 and connected cases. In the meanwhile several of their juniors got promotion as Section Officers.

(3.) The complaint of the petitioners is that the respondents are delaying further promotions to the post above that of Section Officers. They submit that respondents 3 to 27, who are their juniors, were granted promotion as Section Officers as per Exts.P1 and P2 orders. The claim of the petitioners is that they had acquired all the requisite qualifications for promotion as Senior Grade Assistants in June 2009 itself; whereas their juniors who are promoted as per Exts.P1 and P2 orders acquired qualification subsequent to them in July 2009 and thereafter. Pointing out the anomaly in effecting promotions, petitioners submit that they had submitted representations on 27.02.2017 and thereafter the 2nd respondent constituted a committee to examine the complaints and rectify the anomalies. It is stated that the committee submitted Ext.P5 report on 17.05.2017. Thereafter objections were called for on that report on directions from the Vice Chancellor. After examining the objections, the committee submitted a draft proposal before the Vice Chancellor. Thereafter on directions from the 2nd respondent Ext.P6 report was submitted by the committee on 10.08.2017. Petitioners have filed this writ petition, complaining the delay in effecting promotion despite the findings in the report in their favour.
