(1.) The petitioner is aggrieved with the refusal of the 2nd respondent to permit the petitioner to sit for the Part I examination of D.Pharm. Course, in which the petitioner is studying.
(2.) The petitioner's attendance details are produced as Ext.P1. The petitioner does not have 75% attendance in the practicals for three subjects and in one of the said subjects he does not have 75% in the theory also. The petitioner submits that he had taken leave for sixteen days for attending SSC and PSC examinations and due to illness, which resulted in the shortage of attendance.
(3.) On a specific query as to whether any leave application was submitted to the Principal, the learned Counsel submits that there is no provision for that. This Court is unable to accept the contention of the learned Counsel that there is no provision to apply for a leave. If at all, a student is absenting from class, he could very well inform the class teacher or the Principal about his absence and also produce medical certificate, in the case of illness. In the present case, the petitioner does not clearly state as to the number of days he was absent by reason of his illness and also admits that he had taken leave to attend the examinations of PSC and SSC.
