JUDGEMENT

(1.) PETITIONERS are not allowed to write the 3rd year B.Sc Nursing examination for the reason that they have not passed all the papers in the 2nd year Nursing examination. The regulation is not under challenge. However, petitioners' grievance is that they did not get sufficient time for revaluation of the papers for the subjects they have failed. Since 3rd year examination is commencing on 25.1.2007, there will be a direction to the 3rd, 4th and 5th respondents to permit the petitioners to write the 3rd year examination, if they are otherwise eligible, on provisional basis and publish the results only if on revaluation of the failed subjects in the 2nd year examination they pass in such subjects. However, if petitioners or any one of them on revaluation does not pass the 2nd year examination, the 3rd year examination written on provisional basis as directed herein will be cancelled. Revaluation results will be published within two months from the date of making the application.
