The common petitioner in these applications for anticipatory bail is the common fifth accused in Crime No.494/2006 of Thalassery Police Station for offences punishable under Sections 409, 468 and 471, Crime No.196/2006 of Koothuparambu Police Station for offences punishable under Sections 409, 420, 468 and 471 and Crime No.522/2006 of Thalassery Police Station for offences punishable under Sections 409, 468 and 471 IPC.
(2.) The learned Public Prosecutor opposed the application submitting inter alia that the petitioner, to whom the stolen vehicles were entrusted by accused Nos. 1 to 4, had facilitated re-sale of those vehicles after preparing forged documents.
(3.) Anticipatory bail cannot be granted in a case of this nature. There is no reason why the petitioner should not surrender before the Magistrate concerned and seek regular bail. Accordingly if the petitioner surrenders before the Magistrate concerned and files an application for regular bail within two weeks from today, the same shall be considered and disposed of preferably on the same day on which it is filed. The applications are disposed of as above.
