(1.) Petitioner who is the 2nd accused in Crime No.4/2006 of Thrikkakkara Police Station for an offence punishable under sec.394 IPC, seeks anticipatory bail.
(2.) The case of the prosecution is that on 2.1.2006 at about 2.45 p.m. the petitioners and two others coming on a motorbike blocked the car in which the de facto complainant was travelling. After opening the door of the car the de facto complainant was pulled out and intimidated by brandishing a sword. After the complainant was pulled out of the car, the accused persons had committed theft a bag containing Rs.8000/- and toys worth Rs.500/-.
(3.) Apart from the highway robbery committed in a daring manner it is also alleged that the petitioner is involved in other similar cases as well. I am not inclined to grant anticipatory bail in a case of this nature. There is no reason why the petitioner should not surrender before the concerned magistrate and seek regular bail. Accordingly, if the petitioner surrenders before the magistrate and files an application for regular bail within two weeks from today, the same shall be considered and disposed of on merits preferably on the same day on which it is filed. With the above observation this application is disposed of.
