JUDGEMENT

(1.) THE revision petitioner stands convicted for the offence under section 138 of the Negotiable Instruments Act and sentenced to undergo simple imprisonment for six months and to pay a compensation of Rs. 1,50,000/- vide section 357(3) Cr.P.C.

(2.) THE counsel for the revision petitioner has only sought for modification of sentence and for time to make the payment. In the circumstances, sentence is modified to imprisonment till rising of the court and to pay a compensation of Rs. 1,50.000/- vide section 357(3) Cr.P.C and in default to undergo simple imprisonment for three months. THE revision petitioner is granted six months time from today onwards to pay the amount of compensation. THE revision petitioner shall appear before Judicial First Class Magistrate, Mannarkkad on 14.09.2007 to receive sentence. Non bailable warrant if pending shall be kept in abeyance till then.
