JUDGEMENT

(1.) The prayer in this writ petition is to issue a writ of mandamus or other appropriate writ, order or direction commanding the CBI to take over the investigation in Crime No. 34/2004 of Kanjiramkulam Police Station.

(2.) The petitioners are the widow and son of deceased Wilson. It is not in dispute that Sri. Wilson succumbed to the stab injuries sustained by him near his residence in the early hours of February 16, 2004. Though Sri. Wilson was removed to the Medical College Hospital at Trivandrum immediately, he breathed his last on 25th February, 2004.

(3.) Kanjiramkulam Police has registered Crime No. 34/2004 in this connection. One Wilfred and his son Rolland have been arraigned as accused in the above crime. In the statement filed by the Dy. S. P. Crime Branch, Trivandrum it is stated that the investigation is still in progress.
